Massachusetts Uncontested Divorce

While it is possible to represent yourself in the simplest of uncontested divorce cases where the marriage is short in duration, involve no children and very little if any assets, your often times better served to work with a family law attorney that can provide legal representation and help you get the necessary paperwork in order to file yourself to keep legal fees to a minimum.

A divorce goes uncontested when both parties are able to work through all issues and come up with a fair settlement that is agreed to by both parties. In these types of cases, the legal costs to oversee the process, provide legal consultation, and to provide the necessary filing paperwork, can be kept quite low and the time it takes to get a divorce can be quite fast compared to a contested divorce. In uncontested divorce cases, its possible to get a divorce anywhere between 2 - 6 months.

Massachusetts Contested Divorce

I file all my divorce cases as "Contested" regardless of whether the divorce is contested or not. If both sides are able to work things out and there are no contested issues, the divorce can happen fairly quick. If however, the two sides are not able to agree 100% on all issues and need legal council and a judge is needed to help settle disputes than filing the divorce as "Contested" allows the case to proceed along the normal track without having to refile a "Uncontested" divorce at "Contested".
